FERC Accepts Some, Not All, Changes to Colorado Interstate's Penalty Crediting Mechanism

The Commission approved tariff sheets filed by Colorado Interstate Gas Co. (CIG) (RP08-484) to revise its penalty crediting mechanism. The proposal to amend the timing, add interest on penalty revenues, and do an annual report on penalty revenue credits is generally "reasonable," FERC ruled on January 30. However, the Commission rejected CIG's proposal to expand the types of costs that it may offset against penalty revenues, i.e., to include "carrying costs" or "imbalance resolution timing costs." The order directed a compliance filing within 30 days removing all such language from the revised tariff sheets.
