我国农村土地产权制度在正式规则和实施特征两方面存在模糊性，正式规则的模糊性主要表现为政府的有意性模糊和两种形式的产权公共域，实施特征的模糊性则表现在渐进式实施和选择性实施两个方面。已有的农村土地产权制度改革按照产权由模糊到清晰的逻辑，主要沿着不断拓展土地承包经营权内涵和逐步增强地权稳定性两条主线逐步展开。新一轮农村土地产权制度改革仍然需要坚持产权逐步清晰化路径，以土地确权为基础，以“三权分置”为原则，合理细分土地产权；以土地财产权实现为重点，进一步拓展土地承包经营权内涵；以建立城乡统一的建设用地市场为切入点，逐步提高农村集体土地产权强度。%Ambiguity exits in normal rules and the implementation about rural land property rights system in China. The ambiguity of normal rules mainly displays in intentional ambiguity and common areas of property rights. The ambiguity of implementation displays in progressive and selective ways. The reform of rural land property rights system was conducted along the path from fuzzy property rights to clear prop-erty rights;and the two main reform lines were expanding connotation of land-use rights and increasing land ownership stability. A new round of reform should focus on the clarification of rural land property rights;and the rational decomposition of property on the basis of confirming land rights and separation of division;the connotation of land-use rights should be expanded by exercising property rights;and the ru-ral land property rights intensity should be increased through the unification of rural land market and ur-ban land market.
