Mississippi High Court: lead Claims Valid; Matter Remanded For Trial

Shermeker Pollard, individually and on behalf of her son, Trellvion Gaines, sued Sherwin-Williams, NL Industries Inc., Robert Case d/b/a Fayette Lumber & Supply Co., William Darsey, individually and d/b/a Darsey Hardware Co., and Darsey Hardware & Furniture Co., and Hirsch's Store in the Jefferson County Circuit Court, alleging that they were involved in selling lead-based paints. The plaintiffs alleged strict liability, negligence, fraudulent concealment and misrepresentation and damages associated with Gaines' lead-poisoning injuries. The trial and appellate courts both ruled in favor of the defendants.
