The Sentencing Council has issued a new definitive guideline on sentencing for drug offences. It came into force on 27 February 2012. The guideline covers the importation or exportation of controlled drugs, contrary to s. 3 of the Misuse of Drugs Act 1971 and s. 107(2) of the Customs and Excise Management Act 1979; supplying or offering to supply a controlled drug contrary to s. 4(3) of the Misuse of Drugs Act 1971 and possession of a controlled drug with intent to supply contrary to s. 5(3) of the Misuse of Drugs Act 1971; production of a controlled drug and the cultivation of cannabis plant contrary to s. 4(2)(a) or (b) and s. 6(2) of the Misuse of Drugs Act 1971; permitting premises to be used contrary to s. 8 of the Misuse of Drugs Act 1971; and possession of a controlled drug contrary to s. 5(2) of the Misuse of Drugs Act 1971.
