Towards an Environmental Criminal Law in Romania. The Impact of New Criminal Legislation

Under the impact of the transposition into the national law of Directive 2008/99/EC of November 19, 2008 and influenced by the development of international regulations in the matter, Romanian criminal law knows new developments towards the establishment and affirmation of an environmental Romanian criminal law. Although it did not devote a special chapter for environmental offenses, the new Criminal Code (Law no. 28/2009), entered into force on February 1, 2014, improves the general framework of incriminations and penalties and thereby, it fosters a better interpretation and application of criminal provisions from the environmental protection legislation. From this perspective, analyzing the "strengths" and "weaknesses" of the current situation, in the article there are new dimensions of environmental criminal law in Romania and it is proposed that criminal liability in the matter is regulated in a possible future Code of environment.
