矿山职业安全与健康的监管机制创新--兼论我国《矿山安全法》的修改与完善

         

摘要

“三方机制”作为调节劳动基准关系的一项基本制度,其产生和发展具有历史必然性和现实合理性。长期以来,我国矿山安全监管主要通过政府强制实现,存在决策不民主、执行效果不佳等弊端。借鉴国外对话协商、咨询指导、协调监督等“三方机制”模式,我国可以考虑在矿山安全领域建立促进职业安全与健康的“三方机制”,具体路径是修改《矿山安全法》,调整其篇章结构,增设“矿山职业安全与健康‘三方机制’”一章,完善相关罚则。%As a basic system regulating labor standard relations, the emergence and development of tripartite mechanism has histor⁃ical inevitability and realistic rationality. For a long time, China has supervised and governed mine safety mainly by compulsion, which led to undemocratic decision-making mechanism, the poor implementation effect and other defects. In general, tripartite mechanism in⁃cludes three modes according to different functions. They are modes of dialogue, supervision and coordination, and counseling. China may consider the establishment of tripartite mechanism of occupational safety and health in mines according to the pattern abroad. These include modifying Law of the People′s Republic of China on Safety in Mines, adding a chapter of tripartite mechanism of occupational safety and health in mines, and improving the articles on penalty.
