The coming into force of the New Codes also brings with it a series of problems that jurists must answer. In this context, we intend to present some aspects regarding the difficult institution of juridical liability, considered under two aspects: criminal liability and civil liability. The notion of liability, regardless of whether it is civil, criminal, disciplinary, material etc., represents the obligation to endure the consequences of failing to comply with certain rules of conduct, obligation incumbent on the author of the act contrary to these rules and always bearing the imprint of the social disapproval of such conduct.
