An online AD system using copyrighted contents and a method thereof are provided to make an advertiser pay a fee of the copyrighted contents and an AD charge by displaying the copyrighted contents to a user and displaying AD contents corresponding to the copyrighted contents at the same time. A content management system(120) provides the copyrighted contents including an ID code containing copyrighter information and the AD contents including an ID code reader for detecting the ID code. A service providing system(130) displays the AD contents linked with the copyrighted contents to a user terminal(150) if the copyrighted contents are displayed by a request of the user terminal, and relays ID code information detected by the ID code reader. The content management system includes a copyright manager inserting the ID code into the copyrighted contents and storing the copyrighted contents, an AD manager inserting the ID code reader into the AD contents and storing the AD contents, and a service manager generating/storing the ID code of the service providing system.
