According to an embodiment of the present invention, a first partition mode indicating a shape and a direction of a partition, which is a data unit for predictive encoding of a coding unit, for each coding unit that is a data unit for encoding a picture, and the coding unit is used as a partition for detailed motion prediction. Predictive encoding is performed using partitions determined based on the partition level indicating the degree of partitioning, thereby determining a partition to output the encoding result, and encoding and outputting partition information indicating the first partition mode and partition level of the partition. Disclosed is a video encoding method using a variable partition.
