The present invention provides a first partition mode for representing a type and a direction of a partition, which is a data unit for predictive encoding of a coding unit, for each coding unit that is a data unit for coding a picture, and a coding unit as a partition for detailed motion prediction. Predictive encoding is performed using partitions determined based on a partition level indicating a partitioned degree, a partition to output an encoding result is determined, and partition information indicating a first partition mode and partition level of the partition is encoded and output.
