SCRAP TIRES ARE NOT 'WASTE', SAYS PENNSYLVANIA COURT

A three-judge panel of Pennsylvania's Commonwealth Court has ruled unanimously that a scrap tire recycler is not a "waste processing facility" that needs a special permit to operate. Pennsylvania's Department of Environmental Protection (DEP) had argued that discarded tires are "waste" and that facilities handling such tires must obtain a residual waste processing permit. The case involved Tire Jockey Service Inc., a New Jersey-based corporation that operated a tire recycling facility at a brownfield site in Fairless Hills, Pa.
