This case involves competing ownership claims in two warrants (1621, 1622) in Lycoming County. The Proctor Heirs Trust (PHT) asserts ownership in Warrant 1621 by virtue of an 1894 deed reserving certain rights to it. A second trust, the Margaret Proctor Trust (MPT) also asserts ownership of the minerals. MPT has not executed any oil and gas lease. A second group, called the Adverse Defendants, claim ownership by virtue of a 1988 quiet tide action. The Adverse Defendants are not participating in mis appeal which stems from Southwestern's filing of a quiet tide action. Southwestern's interest stems from a putative oil and gas lease executed by PHT to Lancaster Exploration and Production.
