As noted in Judge Elrod's continuing dissent from the majority opinion, the majority recognizes that a court may look at the totality of the circumstances in issuing a contempt citation and mat review by appellate courts should be quited limited. The majority opinion still concludes that even after looking at the totality of the circumstances it was arbitrary and capricious for the district court to have found the Department in civil contempt.
