After denying the stay, the District Court holds a hearing on both the plaintiffs' and defendants' various motions, including motions for summary judgment. Chesapeake's force majeure defense is rooted in part in the then-temporary moratorium of the issuance of permits allowing the use of high volume hydraulic fracturing operations until a generic environmental impact statement (GEIS) is prepared by the New York Department of Environmental Conservation (DEC) pursuant to N.Y. Envtl. Conserv. Law § 8-0109.
