Pooling and Unitization: Pooling Clause

On June 21, 2006, the Neuhards and Range Resources execute an oil and gas lease covering some 47 acres. The lease has a five-year primary term. On June 13, 2011, Range files a Designation of Unit that includes the Neuhard's 47 acre tract within the 395 acre pooled unit. Range Resources engages in various activities preparatory to actual drilling operations before the end of the primary term, including applying for and receiving various permits, negotiating a surface use agreement with the Neuhards and the commencement of construction of access roads and the well pad. On July 1, 2011, the Neuhards notify Range Resources that the lease has terminated. Range Resources drills three horizontal wells of which two underlie the Neuhard's lease.
