WATER POLLUTION BY ABANDONED MINE SITES: ACID MINE DRAINAGE; MINED LAND RECLAMATION

This 1989 case, (hereafter, Idarado) represents a unique example of an acid mine drainage case from an inactive mining and mill site, whose waste rock dumps contained hazardous metals and whose mine discharging waters were allegedly contaminating local water resources that required a remedial clean-up plan under CERCLA. It is distinguishable from other AMD and CERCLA cases in that the response and planned remedial action was initiated by a state rather than the federal government.
