NINTH CIRCUIT COURT OF APPEALS RULES PETITIONERS' CHALLENGE TO BRADWOOD LANDING LNG TERMINAL PROJECT AND ASSOCIATED PIPELINE CONSTRUCTION SOUGHT BY NORTHERNSTAR IS MOOT BY EVENTS AND FERC ORDERS ARE VACATED
The United States Court of Appeals for the Ninth Circuit on 3/2/11 issued an opinion that threw out orders issued by FERC that had granted under section 3 of the Natural Gas Act (NGA) authorization for Bradwood Landing LLC to site, construct, and operate a liquefied natural gas (LNG) import terminal in Clatsop County, Oregon. Also, the court's opinion rendered moot a certificate that FERC issued authorizing NorthernStar Energy LLC to construct and operate a natural gas pipeline that would connect the new Bradwood LNG terminal to the Pacific Northwest's existing natural gas pipeline network. The pipeline would have traversed Clatsop and Columbia Counties, Oregon, and Cowlitz County, Washington.
