EQUITRANS FILES TO ABANDON SUNRISE FACLITIES BY TRANSFER TO SUNRISE PIPELINE, AND THEN TO LATER LEASE BACK THE FACILITIES
On 12/16/11, Equitrans, LP1 (CP12-32) asked FERC to amend its July certificate for certain natural gas pipeline facilities located in Pennsylvania and West Virginia (Sunrise Facilities) to permit Equitrans to transfer a passive ownership interest in facilities that have yet to be constructed to an affiliate, Sunrise Pipeline, LLC (CP11-68). Equitrans also requested permission to abandon the Sunrise Facilities that have already been constructed by transfer of a passive ownership to Sunrise and authority to lease all of the Sunrise Facilities from Sunrise (and operate under the terms and conditions of its tariff as specified in the July 21 certificate order). Equitrans also requested pre-granted abandonment and certificate authority to allow it to terminate the lease and reacquire fee ownership of the Sunrise Facilities upon the expiration of the term of the lease arrangement.
