National Grid and Dominion LDCs Weigh in on Dominion Transmission's Declared Broad Discretion to Decide Whether to Pass along Fuel and Usage Charge Discounts to Replacement Shippers And/ or Managers

The National Grid Gas Delivery Companies (National Grid) submitted comments to FERC on information filed by Dominion Transmission, Inc. (DTI) (RP09-277) regarding the pass-through of releasing shippers' discounted and negotiated usage and fuel charges. These utilities requested the Commission to determine that: (1) if DTI wishes to prohibit a shipper from passing through a usage discount to a replacement shipper, it must provide to the shipper receiving the discount the conditions tied to the discount so that such shippers can determine whether the denial of pass-through of a discount is unduly discriminatory; and (2) if the pipeline fails to develop such conditions and make them available to a releasing shipper that receives a discounted rate, then a presumption will be created that a discount may be passed through to any replacement shipper.
