The issue relates to the freedom of establishment in general. In particular, at stake are provisions of French law restricting the freedom of establishment for bio-medical analysis laboratories.The French Law limits the share capital and voting rights by non-biologists of a company operating as a biomedical analysis laboratory, to a maximum of 25%. Furthermore, it forbids biologists, who may either be a natural or legal person, to hold more than two companies operating as a biomedical analysis laboratory.
