Managing material off-take deals

Supply contracts between a producer of a resource or product ('Supplier') and a buyer of that resource or product ('Off-taker') may be structured to link the supply to a proportion of the Supplier's future production or the Off-taker's future requirements. These agreements are often referred to as off-take agreements. This article considers the reasons why parties choose to enter into such arrangements, highlighting some of the key legal issues which commonly arise.
