The Australia-United States Free Trade Agreement (AUSFTA) entered into force on 1 January 2005 with much optimism for its potential to increase incoming US investment into Australia. However, recent Australian decisions have highlighted the limitations of AUSFTA and signal a cautionary note for US investors proposing to invest in Australian companies or assets.
