ADM Charges Railroads with Fixing Fuel Surcharges

Archer Daniels Midland (ADM) has sued five major U.S. railroads charging them with fixing fuel surcharges. The suit alleges that the defendants—BNSF, CSX Transportation, Kansas City Southern, Norfolk Southern (NS), and Union Pacific (UP)—used the Association of American Railroads (AAR; Washington) as a means to develop, organize, and conduct the alleged price-fixing scheme. AAR is not a defendant in the suit, which was filed in the Minnesota District Court in Minneapolis. ADM says it has paid more than 250 million in fuel surcharges since 2003 and is seeking treble damages in the lawsuit.
