Force Majeure - rights and responsibilities

Force Majeure leave is a leave available to employees who are required to immediately attend to deal with an emergency arising from an unforeseen circumstance, involving an immediate family member or another individual who has domestic dependency on the employee. The Parental Leave Acts 1998 and 2006 provide for an employee to avail of a number of paid days leave, known as Force Majeure leave, to deal with an important and critical family event, and which requires the employee's immediate presence atthe side of the family member or dependent. Such events tend to be an unforeseen injury or illness of a family member or a dependent, and the attendance by the employee must be indispensable to the situation. If the relevant requirements are met, then the employee is permitted to immediate paid leave, to deal with the situation.
