Unlike legitimate royalty purchasers,traffickers in”roy-alty leases”attempt to acquire their interests at signifi-cantly below-market value by relying on deception,a sleight of hand in drafting and the royalty owners misunderstanding what they're signing.Many in the oil and gas industry consider”royalty leasing”to be an industry scourge and the Texas Legislature has attempted to respond.Over the years in the Texas oil patch there have been numerous schemes to defraud mineral owners out of their mineral or royalty rights.One such scam is the mail-order mineral buyout.That scam involves mineral buyers sending mineral owners offer letters and checks in the mail and enclosing a deed that is not consistent with the offer in the letter.Once the deed is signed and the check is cashed,unwary or unsophisticated mineral owners may have conveyed more rights than they intended to or realized.
