Sharp Wins Battle Over Trademark in Brazil Based on Paris Convention

At the end of March, Japan's Sharp became the latest in a series of multinationals operating in Brazil to recover its trademark, basing its case on the 1883 Paris Convention. A constant problem for foreign companies in Brazil has been the registration of their trademarks. In many instances, companies have decided to invest in the country only to discover that their marks have already been the subject of bad faith registrations by persons who demand payment for the transfer of the registered marks. There have also been numerous cases where foreign companies have set up arrangements with Brazilian distributors and later found out that the distributors had registered the foreign marks as their own.
