In January 2007, we wrote about a climate change lawsuit brought by the State of California against numerous automakers, California v. General Motors, et al. Our position was that one industry should not bear the burden of rectifying a problem caused over a long time period, with a global scope, and to which each and every one of has contributed in some small way. It's just not fair. The California case was dismissed by the federal district court in September, and an appeal is pending. The weighty ground underlying the court dismissal echoes concerns that we articulated in September 2007: policy should be set by elected officials, not by courts.
