The intellectual property cases surveyed this year are high profile and intriguing, not to mention highly applicable to today's cyber-savvy business lawyer. This Survey answered most of the questions posed at the end of last year's survey, but the status of keyword advertising is still in flux in light of the U.S. Court of Appeals for the Second Circuit's clarification and the court cases on the same topic being handed down worldwide. In addition, will the U.S. Supreme Court clarify the meaning of direct infringement in digital media and will other circuits have the opportunity to hear DMCA cases in 2009-2010? Finally, what is the future of business method patents? Stay tuned for these and other interesting issues that are sure to arise over the course of the next year.
