Nation's First Encryption Law

While 39 states have already passed data protection laws, these mandates are primarily concerned with data at rest, requiring enterprises to notify customers should a breach occur. Nevada's NRS 597.970, in effect since Oct. 1, is thought to be unique in being the first law requiring not only protection of stored data, but the encryption of transmitted data. However, even before the law wields any influence, many experts question whether a patchwork of state laws is efficient in a world where internet transactions cross state and country lines.
