The Consequences of failing to comply with notice provisions in construction contracts can be serious. Two recent cases highlight the need for architects to take care when advising on the service of notices.rnIn WW Gear Construction Ltd v McGee Group Ltd, the parties had entered into an amended form of the JCT Trade Contract Terms 2002 edition. A dispute arose as to whether or not McGee's ability to claim loss and expense was conditional upon it having made an application to the construction manager within two months of it becoming apparent that progress of the works had been delayed.
