Trump's Executive Orders Seek to Curb the Role and Influence of Guidance Documents

From the beginning, the Trump Administration has pursued a broad regulatory reform agenda to reduce the footprint of the federal government. Soon after his inauguration President Trump issued Executive Order ("EO") 13771, commonly known as the "2-for-1 Rule", which sought to reduce internal policies and agency guidance in addition to requiring agencies to identify two regulations that would have to be rescinded for every one new regulation an agency wanted to promulgate. This was followed by EO 13777, which established regulatory task forces to improve the implementation of regulatory reform initiatives and policies and to identify regulations for repeal, replacement, or modification. To enforce these efforts, the White House has consolidated regulatory power within the Executive branch by empowering the OMB and the Office of Information and Regulatory Affairs ("OIRA").
