The present judgment mounts a fact-specific assault on the deportation of Qatada to face trial in which torture-tainted evidence could be used, but it is far from a defeat to the deportation with assurances regime generally. The Counter-Terrorism Review 2011 concluded that the UK would continue to pursue assurances with foreign governments. Since the above account has been compiled, events have taken a number of other turns. The UK government has accepted the ruling of the European Court of Human Rights, making clear that a referral to the Grand Chamber would not be sought, and has pursued the conclusion of satisfactory assurances with the Jordanian authorities.
