Litigation Schedule Ensures 2012 Campaign Focus On EPA's GHG Rules

A federal appellate court has issued the first briefing schedule in consolidated litigation challenging EPA's greenhouse gas (GHG) permitting rules, with the cases now slated to run well into 2012 and thus into the thick of the next presidential campaign - ensuring continued high-profile focus on the controversial rules. The U.S. Court of Appeals for the District of Columbia Circuit March 21 announced a schedule for merits briefing in consolidated litigation - Coalition for Responsible Regulation, et al. v. EPA - against two EPA GHG rules: the so-called Johnson memo reconsideration, which triggered GHG permit requirements for new and modified stationary sources, and the "tailoring" rule, which seeks to exempt small sources from GHG permit requirements.
