民事监督案件受理审查存在的问题与对策--以民事诉讼法第209条规定为视角

摘要

新民事诉讼法对人民检察院受理民事监督案件赋予了新的要求，但规定较为粗疏，运用体系解释等方法，对监督申请期间、逾期未作裁定、再审判决的明显错误等问题展开探讨并提出对策。%The new civil procedure law gives rise to the new requirements to the People's Procuratorate in accepting civil supervision cases , but the rules are not well -defined enough . The author , by using system interpretation methods , explores problems in supervision of the application period , problems of failing to make a decision , mistakes in second judgment and then puts forward some countermeasures .
