行走于新闻自由与司法独立之间——关于“媒体审判”之争论点分析

＂媒体审判＂是指因媒体报道和评论案件审判,形成巨大的舆论压力,从而影响审判结果的现象。媒体报道案件审判是确保新闻自由权的正当行为,具有监督司法审判、确保司法公正的作用;但是媒体如果对案件过度炒作,超越了合理的界限,就会误导舆论,影响司法独立和司法公正。因此,既要充分保证新闻自由,保证新闻监督作用的发挥,又要采取一些技术上的措施,防止审判结果不公正情况的发生。%＂Trial by media＂ is the report or review on cases before or during the course of litigation,forming great pressure from the public opinion and affecting the result of trial.Reporting on case by media is a proper behavior which has the function of ensuring press freedom,citizens＇ right to know the facts of a case,the supervision of judicial trials and judicial impartiality.But media＇s excessive profiteering activities will affect the judicial independence and the judicial impartiality and hence mislead the public opinion if media＇s report exceeds the rational limit.Some technical measures must be taken to regulate the ＂trial by media＂and avoid unfair trial.
