人民法院委托行业协会调解的实践及其规制——以金融纠纷调解为视角

摘要

人民法院委托行业协会调解制度是努力构建多元化纠纷解决机制背景下出现的一种新型委托调解方式。必须通过厘定可委托调解案件范围的界限、适用辨清事实和司法审查相结合的辅助制度、加强培训及增加激励等举措完善该项制度。%The system of court-entrusted mediation carried out by industry associations is a new mode of entrusted mediation appearing at a time when we are working hard for a dispute resolution mechanism with multi-sided participation.The system can be improved by such measures as defining the scope of entrustable cases,applying the auxiliary system of combining fact identification with judicial review,strengthening relevant training and enhancing motivation.
