中韩两国专利侵权赔偿问题研究

摘要

专利侵权赔偿作为专利侵权民事责任之一，其计算方法及适用顺位是一个复杂问题。基于保护专利权的基本目的，法律拟制了多种赔偿计算方法，在个别计算方法中又进行了二次拟制。如何确定赔偿种类及其计算方法，这是中韩两国都面临的问题。%As one of civil responsibility, patent infringement compensation appears complicated on damage kinds, calculating and sequence. Based on the aim of patent protecting, patent law regulates several ways of calculating compensation, and makes secondary ifction in exceptional methods. China and South Korea face the same problem of applying different types of patent infringement compensation and calculating method.
