Accompanied with fast-developing economic globalization, the continuous expansion of modern intellectual property has brought many negative effects. These effects are embodied on the conflict between intellectual property rights and basic human rights such as subsistence right, development right, privacy and right of access to information and so on. The private interests of developed country are expanding while the basic human rights of developing country are facing challenges. Therefore, the intellectual property system is facing a crisis of human rights. Based on various theories, it is conifrmed that intellectual property owns attribute of human rights. Besides, through the performance and reasons of the conlfict between intellectual property rights and human rights, it can be helpful to further clarify the intrinsic relationship of the above two. Lastly, the author explains the theoretical ways and suggests active measures, both international and domestic, can be taken to coordinate the conlfict between intellectual property rights and human rights.%随着经济全球化进程加快，现代知识产权的不断扩张带来了许多负面影响，突出表现为知识产权与生存权、发展权、隐私权、信息获取自由权等基本人权发生冲突，造成了发达国家私益的日益膨胀，而发展中国家和最不发达国家的基本人权遭受严重挑战，因此知识产权面临人权危机。基于知识产权的人权属性理论，明确知识产权具有人权属性；挖掘知识产权与人权冲突的表现和原因，厘定知识产权与人权的内在关系；从理论上阐释关于协调知识产权与人权冲突的做法，建议从国内层面与国际层面积极采取措施协调知识产权与人权的冲突，化解知识产权的人权危机。
