精神卫生立法的国际视野和中国现实——来自中国医师协会精神科医师分会的观点

摘要

<中华人民共和国精神卫生法(草案)>征求意见稿在全社会引起广泛关注的同时,也被赋予了过多的超出立法宗旨的意义.我国在立法中的一些争议问题在欧美国家的精神卫生立法进程中也曾出现过.本文从国内外精神卫生服务及其立法特点、中国的现实状况等角度出发,对当前的几个焦点问题如立法宗旨、非自愿住院、监护人权利等进行评价并提出观点和建议.%The graft of Chinese Mental Health Law called great attention in mass media and was imposed many meanings beyond legislation. Many problems raised during the legislation were also appeared in the similar process decades before when European and North American countries trying to establish their mental health law. The author discussed these problems based on the reality of China and gave their suggestions and advices a-round some focuses.
