The regulation of the preliminary procedure in the Code of Criminal Procedure, although justified through objectives related to the celerity and legality of criminal trial has generated hesitation and the returns of the legislature, such as difficulties in implementation due to the lack of an impact study on the quadripartite separation of judicial functions. The procedure does not always guarantee an expeditious trial and in some cases may constitute an obstacle to the exercise of the right to free access to justice.
