The paper analyzes the issue of arbitration agreement formal validity requirements under the Romanian legal regulations, focusing on the underlying policies that have given rise to the current form requirement.After a brief introduction, the second section advances discussion on the subject as is provided by the Romanian New Civil Code regulation and the next section addresses the issue under the New Civil Procedure Code provisions, which are strongly related and determine the new concepts on the topic under the Romanian legislation.
