The apparatus has a distillation column (7) containing a head condenser with a dephlegmator (3B), and a cooled and purified air supplying unit (1) to supply cooled and purified air to the column. The column has a gaseous nitrogen supplying unit for supplying gaseous nitrogen to the condenser, and a liquid nitrogen supplying unit for supplying liquid nitrogen from an exterior source e.g. frigorie source, to a head of the column. An extracting unit extracts nitrogen enriched product in the column head, and a horizontal section of the dephlegmator covers 70 percentage of a section of the column.
