PURPOSE: A mobile terminal performing action recognition and a method thereof are provided to store an amount of rotations indicating an inclining degree from a reference position which is predetermined on the basis of at least two axes, and to determine whether a proximity sensor is activated based on the stored amount of rotations.;CONSTITUTION: A state recognition unit (20) recognizes an amount of rotations indicating an inclining degree of a portable terminal from a reference position which is predetermined on the basis of at least two axes, as state information of the portable terminal. An activated state storing unit (30) stores the amount of rotations in relation to the at least two axes as a proximity sensor activation value. If the state information recognized by the state recognition unit is included in an error range predetermined based on the proximity sensor activation value, a control unit (90) activates a proximity sensor unit.
