This thesis studies the scope of State’s liability by alteration of the economic balance in the new Service Contracts of Exploration and Exploitation of Petroleum, signed between Ecuador and several private companies in November 2010; established by the reformatory law of 27 July 2009 of hydrocarbons law.The contractual clause related to the restoration of the economic balance in the new contract establishes several circumstances in which the State is obliged to apply a “correction factor” to absorb the increase or decrease of the economic burden: modifications to tax regime, environmental law or foreign exchange law reforms, among others. The legal issue to determine what the duty of the State is, under this contractual provision, when a situation that is not expressly established in the clause occurs. For instance, in the case of the enactment of a local regulation which changes the use of land in the area of exploration and exploitation of oil.The response to this issue will be determined through the study of the principles that govern the administrative contract, the general principle of State’s liability and the theory of economic balance in contracts.
