The present research is focused on establishing the problem of self-incrimination that is generated through the summary criminal procedure regulated in the Arts. 369 and 370 of the Code of Criminal Procedure, together with the clarification of its features and controversial issues. The latter, as a result of the implementation of that figure brought under the common law. The investigation will start with a legal analysis - doctrinaire through primary sources such as the Constitution and criminal procedure code, the same way will be considered secondary, in this case, bibliographic text relating to summary criminal proceedings as just those in which talk of due process, presumption of innocence, the guarantees of the accused and the trial. Regarding the above, basically leave both the manual and books on criminal procedure doctrine.
