This Pesticide Registration (PR) notice clarifies EPA's interpretation of the211u001escope of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) Section 211u001e17(a)(1), as it relates to the import of unregistered pesticides, devices or 211u001eactive ingredients used in producing a pesticide when the importation is solely 211u001efor the purpose of formulation or packaging for subsequent export. Under the 211u001einterpretation provided in this PR notice, such pesticides do not require 211u001eregistration under FIFRA, as long as the comply with the provisions outlined 211u001ebelow. This interpretation is effective immediately. In general, unregistered 211u001epesticides and unregistered active ingrediants are not permitted to be imported. 211u001eHowever, if a pesticide or unregistered active ingredient is being imported for 211u001ethe sole purpose of meeting the specifications of a foreign purchaser, such as 211u001eimport is permitted. The Agency interprets Section 17(a)(1) to allow the 211u001eimportation of unregistered pesticides or unregistered active ingredients used in 211u001eproducing a pesticide, provided the ultimate pesticide is produced for export 211u001eonly according to the specifications of the foreign purchaser.
