On November 23, 2003, Nation Ford Chemical (“NFC”) and Sun Chemical Corp. (“Sun”), domestic producers of CVP?23, jointly filed a petition alleging that imports of CVP?23 from India were being subsidized and that imports of CVP?23 from China and India were being sold at less than fair value in the United States.1 In December 2004, the Commission determined that a domestic industry was materially injured by reason of cumulated subject imports of CVP?23 from China and India.2 On December 29, 2004, the U.S. Department of Commerce (“Commerce”) issued a countervailing duty order on subject imports from India and antidumping duty orders on subject imports from China and India.
