New Administrative Penalty Procedures.

As a result of the Administrator's recent delegation of authorities under Section 311 of the Clean Water Act (CWA), we are now able to issue Oil Pollution Act (OPA) administrative penalty procedural guidance for oil and hazardous substance spill violations of CWA Section 311(b)(3). We have attached to the memorandum a copy of (1) the Administrator's new delegations of OPA authority; (2) a redelegation of Class I CWA representation authority from the Assistant Administrator for Enforcement.
