Source Confident California Contingent Fee Ruling Will Not Stand

SAN JOSE, Calif. - A source involved in the public nuisance lawsuit brought by numerous municipalities and city governments against the former makers of lead paint told Mealey Publications April 19 that the plaintiffs are confident that a state court judge's ruling precluding contingent fee agreements will be overturned on appeal (County of Santa Clara, et al. v. Atlantic Richfield Company, et at No. 1-00-CV-788657, Calif. Super., Santa Clara Co.; See April 2007, Page 6). As of publication, an appeal was imminent, although no documents had been filed. Santa Clara County, Santa Cruz County, Calif., the City and County of San Francisco, the San Francisco Unified School District, the San Francisco Housing Authority, Alameda County, Calif., the City of Oakland, Calif., the Oakland Unified School District, the Oakland Housing Authority, Solana County, Calif., and Kern County, Calif., sued Atlantic Richfield Co.
