THE U.S. COURT OF INTERNATIONAL TRADE IN 2011: APPEALS FROM THE U.S. INTERNATIONAL TRADE COMMISSION AND DEPARTMENT OF LABOR

In 2011, the U.S. Court of International Trade reviewed eight antidumping and countervailing duty determinations issued by the U.S. International Trade Commission (ITC) as well as one trade adjustment assistance eligibility determination issued by the US. Department of Labor. This Article briefly revisits the Court's decisions in all of these cases. It further focuses on two ITC appeals that highlight the tension connected with the deferential standard of review and the Court's ability to meaningfully affect legally inadequate determinations by the ITC.
